Introduction: These terms and conditions outline the rules and regulations for the use of KJA Artists’ website and services. By accessing or using our website and services, you agree to these terms and conditions.
Interpretation: The following definitions apply to these terms and conditions:
“Client” refers to any individual, company or organization that engages KJA Artists for services.
“Artist” refers to any individual or entity that provides services to KJA Artists.
“Services” refer to all services provided by KJA Artists, including but not limited to illustration and animation services.
“Agreement” refers to the contract entered into by KJA Artists and the Client for the provision of services.
Services: KJA Artists provides a range of art and design services to Clients. All services are subject to the terms and conditions outlined in this agreement.
Fees: The fees for KJA Artists’ services will be outlined in the full T & C’s Agreement at the time of quotation. Payment for services must be made in accordance with the terms outlined in the Agreement.
Intellectual Property: KJA Artists retains all intellectual property rights for any work created by the Artists under this Agreement. Clients may not use any work created by KJA Artists for any other purpose without prior written consent and agreement. Copyright and ownership if required can be negotiated by mutual agreement.
Confidentiality: KJA Artists agrees to keep all information provided by the Client confidential and not to disclose such information to any third party without prior written consent.
Termination: Either party may terminate this Agreement at any time by giving written notice to the other party. In the event of termination, the Client must pay all fees due up to the date of termination on a pro rata basis but no less than 50% of the originally agreed contractual fees.
Limitation of Liability: KJA Artists will not be liable for any indirect or consequential loss, damage or expense arising from the provision of services.
Direct Access: Should the Client approach a KJA artist directly or through a third party for the supply of services at any time after being made aware of that artist, either through the KJA artists website or by direct introduction, without permission from KJA artists a fee will be immediately payable to KJA artists equivalent to 50% of the value of that work and any subsequent work in perpetuity.
Governing Law: This Agreement is governed by and will be construed in accordance with the laws of England and Wales. Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.
Entire Agreement: This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, understandings or arrangements, whether written or oral, relating to the provision of services.
Amendments: KJA Artists may amend these terms and conditions at any time by publishing a new version on its website. Clients are responsible for reviewing the most current version of the terms and conditions before engaging KJA Artists’ services.
